I was contacted by one of our Chapter 61A property owners inquiring if marijuana cultivation is a eligible under Chapter 61A. The information I have found online states that farmers should contact their local assessors to determine whether marijuana is agricultural or horticulutral use on their 61A land. I also found an article regarding growing hemp and marijuana which stated that Mass Department of Revenue has determined eligibilty of land used to grow hemp and marijuana for classification under CH61A, Section 2 requires clarification by the legislature and that any determination under the current law may be made by the local assessor.

Has anyone had any experience with this or have any suggestions on where we may get some guidance with this matter?
